Biking Groups Eyeing Lawsuit

OKLAHOMA CITY -- Mountain biking groups across the nation are watching a lawsuit in Oklahoma that some believe could affect trail usage everywhere.

Jerry Reese is still recovering after being severely hurt while riding his bike on the Bluff Creek Trail, just north of Lake Hefner in Oklahoma City.

Now, he's suing, and that concerns other riders who worry his lawsuit might close the popular trail.

"Anybody that rides a mountain bike off-road knows it's more difficult to control your bicycle," said Oklahoma Earthbike Fellowship Vice President Steve Ashmore. "You have to pay closer attention, and that's part of what makes it fun."

Reese said he was riding Bluff Creek, a trail he had been on several times before. However, on one lap, he spotted a broken board near the front of a bridge. It sent him flying off the side near the other end of the bridge, severely injuring his spine.

"You know, I think I can get up and just do things that I've always done before, but of course my body doesn't work the way it used to," Reese said.

Next month, his lawsuit against the group in charge of maintaining the city-owned trail goes to trial.

"As a group, we are very sorry anyone in the mountain bike community is injured," Ashmore said.

Ashmore and his comrades wish Reese a speedy recovery. They just hope his lawsuit doesn't leave them without a place to ride.

"Somebody has to pay for that, and I don't want it shut down," Ashmore said.

Reese's attorney said crashes are to be expected from natural difficulties on the trail such as rocks or trees, but not from a broken board on a man-made bridge. The lawyer said Reese is not asking for the trail to be closed, but for money to help cover his medical bills.

I ate it on a root today, on a tree that is owned by the GVRD.

Im pretty upset about it.....time to call that personal injury laywer I saw on the TV listings channel....

Seems very lame - he spotted the broken board but rode over it anyhow? So if I spot that the light is red and walk out into traffic anyhow it's someone else's fault?

I am so sick of Canadians saying crap like this. It has nothing to do with being American other that our legal system allows for such stupid lawsuits. The problem with the Legal system in "general" not a USA/North America" thing is that people are now in the state of mind that they do not want to take responsibility for there own actions...

You take this and add in the shit that you see in TV commercials with all these Law firms advertising "Class action lawsuits" and you have the perfect recepie for this type of shit.

Remember Humans are like water, they will take the easiest path with the least resistance....

I had to take personal action for myself. With kids and a family personal Life/disability insurance was a none issue for riding the shore. I consider it the price for play...

its true, some americans sue more because they are not as aware about the world, themselves(or responsiblity for their own actions), or their surroundings.......compared to canadians at least.
some americans want all the trappings of being 'grown up', without any of the responsibilty.

I work in the industry and sueing in the "pharma drug testing" is the worst that is out.

Blame all the people who sue and the lawyers involved for the price of your drugs to be so high...

Once again the "Take reponsibility for your own actions" spiel comes out but I bet that way over half the people who say that don't have any life or liability insurance. What the hell for, when 50 bucks a month can sure by you some nice bike stuff. REALLY take two seconds to think if you are taking responsibility for your own actions then post and PROVE it.

I don't condone that sueing is right but when your face with an over half a Million dollar bill right off the bat then to revamp you life as you know it what would you do?

I bet I get a bunch of different vague answers with no real thought.
