Rights w the po 9

So last friday i was pulling into tge parking lot at my local fav beach. Myself and 3 buddies piled out of my car.. We had beer in the trunk but nothing visible. The rcmp happened to be there running random patrol.. We were approx 10 ft from the car when they came up to us and as i was driving they asked for my dl and rege. I provided this info and all was fine... But i was left wondering was i required by law to do so?

Anybody know for sure?ImageUploadedByTapatalk1342029679.798763.jpg

Do the police have the right to ask for I.D.?
The driver of a motor vehicle has to produce identification on demand by a police officer, under provincial laws. Otherwise, there is no general right of the police to demand I.D. from someone who is just going about his or her business on the street. On the other hand, if you have committed a minor offence, providing proof of identity to the police will often mean you will not be taken under arrest to the station, so can be helpful to everyone.

Do the police have the right to question you?
The police always have the right to question you. The real question is whether they have the right to make you stay around and give answers (that is, "detain" you).

@ sven yea i read up on that part as well...i had already used the google, then i had to use it again for this..LMGTFY..but thnx for calling me a cool cat..

yea xxx they saw me gettn out of my car..which by the way is a 96 altima 4 dr all white w no hub caps blk rims. it looks like a grandpa wanna-be mini cop car. which it is. i got from my dad and he is a grandpa....

i was just annoyed that even tho i wasnt driving the car when they came up to me (they were not involved in vehicle stops, it was a beach patrol) that they asked me for my dl and reg.

they didnt ask the other guys. i did ask the officer if she had the right to ask for these things and she said yes i do..so i did etc...

not like a rosa parks thing...but my rights felt bumped up on...

FTR i wasnt drunk i was gettn set to get the beers out of the trunk and go get drunk..

So they seen that the other guys were not driving but you were so the "stop" probably comes under the MV act or sft, be glad they didn't decide to search your car and take your beer

we used to run the anti-party road blocks by putting the beer under the hood, you could put a doz kokanee on either side of a 289 but if you left it there for very long the beer gets pretty warm because you were right on top of the exhaust manifolds

but even anti party patrol - he's of age and had the beer in the trunk - perfectly legal. I'd put up a fuss if they wanted to dump it.

Well how many ways can they fuck with you ?

Its my understanding if the case is open they can take the case but if the case is sealed apparently they can't take the case unless they check your DL and notice you are really far from home on vacation or sft in which case there is no way you are just transporting the case of beer home ... explained to me by a cop

a way around this is to leave the case sealed in the back of the trunk up against the back seat so john law won't bother to reach in and grab it at which point he will notice you have been pulling beers out of a hole cut in the bottom of that case

I rest my case

Keep in mind Police are not required to tell you the truth or the law. Their job is to build a case against you and they can say pretty well anything they want to do that. Having said that most police are usually pretty straight forward. Treat them with respect and they will usually do the same to you. If you ever feel like they are asking you to do something that will incriminate you, just stop talking to them. Remember this phrase "I do not consent to any searches" say it out loud a few times right now and get used to saying it, one day you might have to!

Or just to play devil's advocate.. checking to make sure who the car belongs to and who's driving it matches it. Or in the happening I had a couple of years ago I had Gabi in the car.

Contrary to the overblown cops are the sith on here hype alot of these ID requests when it comes to vehicles isn't a conspiracy of evil. Simply seeing if any red flags pop up... like say not allowed to drive with more then 1 passenger, suspended license, banned from driving, and so on. Not all cops even the RCMP are retards.

So if I was cop , which I am not . (far from considering a few of my actions and activities).
I would try for any question or demand that would result in further time spent with said person in question (uncle duke).
asking for regi , and dl would result in a few mins of conversation.
Just like those boarder patrol agents that throw odd ball questions at you . looking for an extra blink , bead of sweat, soiled pants and a running reaction.

Yes it sucks , yes i would protest. No you don't really have a leg to stand on.

Let's look at this from the other way.

Uncle Duke has a license that has restrictions... no driving at night and only one passenger in the car. Shortly after leaving the beach an incident occurs and someone is killed. It gets out that Duke had those restrictions and people start asking why the cops didn't stop him.

As Rivs says the only way for cops to catch this stuff is to ask for licenses and converse with you.
