If the latch failed, can you see if the company that makes the bike rack has a guarantee or something about bikes falling off?

pg_trail_junkie
03-15-2003, 09:03 AM
Dude sorry to hear about your bike, you have to get a bcaa all risks insurance. Couple years ago I cased real hard. Snapoped my fork,f@@ked my brake and wheel.Cost just about $2000 and insurance paid for it all. It only costs me about $150ish/year!!
:thepimp:

hey bouch, did i hear the lach failed?? HHHMMMM smells like a law suit!!! but i think thats the same thing that happened to shanes old bike, fell off ruperts car and twisted his JR.T!!! ******* ALL BAD CARMA GOING TOWARD THE DRIVER OF THAT CAR**********

brian
03-15-2003, 09:36 AM
this same thing happened to my brother. his bike fell off and a car ran it over. I was the second car behind but missed it. too bad haahaa. it was covered under there hime insurance. you should look into that.

Pennywise

either way..what a way to lose your best friend :(

UFO
03-15-2003, 09:54 AM
sounds rough you guys, i really feel for you

what i dont get is how is it the drivers' faults for running over the bikes? i am sure they were gunning it and aiming to hit them. if anything, you guys would have to pay the insurance deductables for damages to their respective cars, and maybe their insurance would cover your bikes as well?

i really dont think the drivers are at fault though!

Slamigo
03-15-2003, 10:17 AM
I'd have to agree with UFO.
If I was driving along and the bikes from the car in front of me fell off and did damage to my van, I'd be hella pissed. You guys are lucky that you are not paying their deductible to have their cars fixed. Think about it. What if the bike bounced first and went through someone's windshield? That's a seriously dangerous situation.
I am just happy that nobody got hurt.
But I also think that the other driver should have stopped. That sounds kinda fishy? I think that any reasonable person would stop after plowing a bike. That's just strange...
All the same, not a good situation and I hope you get set up with a sweet new ride:thepimp:

BuckChoklit
03-15-2003, 10:23 AM
yaay,I know it's lame but frick. Dylan's told me a few times about how his own bike had fallen off twicw fromt hat thing. So I mean this bound to happem. IF either of you guys wnat a new bike I'll sell you one, really cheap.

BOUCH
03-15-2003, 10:42 AM
i dont think neither me or evan ever said it was the drivers fault. They fell off the rack it isnt really anyones fault. The guy who clipped evans bike got his whole bumper all scratched up but the guy who went right over my bike didnt stop. The damage to his car must be nuts. Neil told me that his friends bike got covered with house insurance too so im going to look into that.

UFO
03-15-2003, 11:11 AM
yeah, im not saying that either you or evan said it was the driver's fault. its some of these other vigilante groms out there who are in support of you guys, albeit in the wrong way. the driver isnt making you cover his deductable right?

anyways, i hope you are able to get back on your wheels soon. best of luck and fortune.

yeah i hate using our rack, i ussually put my bike in the back of our .... SUV (lol) , but soemtimes i have to put it on the rack, so i changed the thing that holds them down lol, i put a bolt and nut on intead of the plastic lockdown device... and then i duct tape it so it doesnt move and stuff.

"insecure load" That is if you don't have a ribbon tagging a protruding peice of lumber off of you car or if somthing flys off because you are a stupid fuck. We had those bikes pretty much nailed down. They shouldn't have come off. It's only a fine if a cop sees it happen.

davet
03-16-2003, 06:40 PM
Sorry but "Loss of load" means the load you were carrying fell off. It doesn't matter what the reason is. The driver of a vehicle is responsible for the load it carries. Not that it matters, you guys just had some bad luck, shit happens. It's a drag that your bikes were damaged, but it could have been worse. Just think of what would have happened it you caused an accident. That would have been a really bad day.

I had a BIG talk with the people at ICBC...It's under "insecure load"... "loss of load" isn't used (old terms) any more or some crap...needless to say I didn't care to ask why. However the claim adjuster did say that an "insecure load" can be argued as it was the latch that failed and was not just negligence.....no fine was pressed against me adressing the load.

I'm calling 24/7, doing w/e I can to get Bouchy a bike. So far things have gone my way.... I've got him FSA cranks, Hayes HMX & 6 inch disk, Still X fingers on rims...Seeing about his fork tomorrow, and frame is still in the air....he will be riding one of my old frames for the time being....

As for Norco...shit happens :)
