Is it normal after a rebuild (both dust seal and main seals) for the fork to be just a tiny bit sticky because the seals have to break in again?

Yes.
It will go away after a ride or two. Completely normal.

BTW this may be a real dumb question but they say 70mm from the top of the leg should be the oil height, well how would u go about getting an exact measurement kind of hard to see down the slider no? I was trying with a ruler, was hard to tell where i was really at.

Dip it in a bit to make a solid oil mark, then make a mark on your stick(ruler/chopstick) where you're holding it at the top of the stanchion. Measure from where the bottom oil mark starts to the top mark. Very accurate.
