We were riding tonight and on the way home ross got hit by a car. He is all right, cut and bruised, but nothing broken ( we think). His doc is done. Frame broken, fork broken, wheel and so on. Luckly ross is ok. MAde for an intresting night. Ross will have much more to say.

i just checked out those photos and you dont look to good either. i'm not into pulling out the sue card but for getting nailed by a driver who was speeding and not paying attention i would be calling a lawyer for sure. put a claim in and protect yourself! it can take several years until you start feeling some of the affects from this (back pains, migraines, etc) and could result in yourself becoming permanently unemployed and if its not on record you will be getting squat except a small welfare (cpp) check every month.

totally different scenario, you can not compare the two incidents.
a strong majority of people in the lower mainland can not or shouldnt be driving and the province does nothing on correcting the problem. you are not suing the person directly because thats what a thing called insurance is protecting you from (to an extent).

Well, it sounds like it was at a light, with the light green for the vehicle. The vehicle shouldn't stop, as it has the right of way. I could understand if it was just a regular crosswalk, no light, but it sounds like it is Ross' fault.

First off - glad you're okay Ross, judging by your photos, you got lucky by not getting tagged head on.
If the individual who hit you was indeed speeding (and someone can correct me on this, but I believe that RCMP can determine this based on skidmarks at scene), then that individual does indeed carry a measure of culpability. Whether you want to check into that or not is your call.

Theres no skid marks before he hit me.. it happend in less then 1/2 of a second.

Ouch! Welcome to the club Ross. Mine was similar, no brakes before impact but I got hit directly from behind while going up a hill by a car doing like 60kmh at least.
Rest up, heal up, then get yourself to a chiro or a physio and get checked out at least. Cars are heavy and a lot of stuff could have been knocked out of place. Even if you can't claim partial fault ICBC may pick up the medical fees. It would be worth looking into for your healths sake.

you are driving and someone bolts out in front of your car (on a bike lets say) and you smack em your vehicle has 400 bucks damage... the guy on the bike is at fault , he lived and is going to be ok
you drive the car home, call icbc to report the accident and they tell you the biker isn't covered and if you want the car fixed you have to sue. what are you guys gonna do?

I,ve had 3 NOT MY FAULT accidents with my truck in the last 4 months. ICBC wrote off my truck twice and I've fixed it up nice. Will post pics of the flat deck with custom bike rack soon going to paint on Monday.
Anyways the point is that most (Automobile) drivers are in way to much of a hurry. It creates a situation where snap decisions are made routinely. It also creates lots of flippin' loosers who can't admit they did something wrong. If Mr. Van was speeding or fiddling with his cell phone or picking his nose, how would Ross know. It all happened very fast I'm sure. Theres no certain way to tell if it was 50/50 fault. Mr. Vans bloody lucky and should actually count his blessings not try to cash in. IMHO.
